Etyka pubilikacji

 

W trosce o wysoką jakość i naukową rzetelność publikowanych treści, Redakcja czasopisma „Prawne Problemy Górnictwa i Ochrony Środowiska” wdrożyła zalecenia Komitetu ds. Etyki Publikacyjnej (Committee on Publication Ethics – COPE) zawartych w Code of Conduct and Best Practice Guidelines for Journal Editors (Kodeks postępowania i wytyczne dotyczące najlepszych praktyk dla redaktorów czasopism naukowych), COPE Ethical Guidelines for Peer Reviewers (Wskazówki etyczne Komisji Etyki Publikacyjnej dla recenzentów prac naukowych). Wszystkie strony zaangażowane w proces publikacji: autor, redaktor czasopisma, recenzent, wydawca są zobligowane do przestrzegania standardów w zakresie etyki publikacyjnej.

Wszystkie teksty przesłane do recenzowanej publikacji w czasopiśmie powinny być zgodne ze standardami etycznego postępowania ogłoszonymi przez COPE.

I. AUTORZY

• Autor jest zobowiązany do rzetelnego prowadzenia, prezentowania i obiektywnej interpretacji badań naukowych.
• W tekście powinny być ujawnione źródła danych i informacje, które umożliwią powtórne przeprowadzenie badań.
• Tekst powinien stanowić własność intelektualną autora. Niedopuszczalny jest plagiat, autoplagiat. Aby przeciwdziałać przypadkom nierzetelności naukowej typu „ghostwriting” i „guest authorship”  wszystkie osoby, które wniosły wkład w powstanie publikacji, powinny zostać wymienione jako współautorzy. Wszyscy autorzy muszą zatwierdzić ostateczną wersję utworu i wyrazić zgodę na jego publikację. Autorzy wskazują w pisemnym oświadczeniu swój wkład w stworzenie zgłaszanego utworu.
• Autor powinien cytować publikacje, które miały wpływ na jego pracę we właściwy sposób.
• Autor powinien niezwłocznie powiadomić redaktora naczelnego, jeśli zauważy znaczące błędy w swojej publikacji. We współpracy z redaktorem naczelnym i wydawcą powinna zostać opublikowana errata, aneks, sprostowanie lub wycofanie publikacji.
• Wszyscy autorzy są zobowiązani do wycofania lub korekty błędów w przypadku ich wykrycia.
• Wyniki badań nie mogą być publikowane w więcej niż jednym czasopiśmie.
• Konflikt interesów stanowią relacje podległości zawodowej, zależności ekonomicznej, a także relacje towarzyskie, które mogą wpływać na bezstronną ocenę wartości tekstu. Redakcja wymaga od autora oświadczenia o braku konfliktu interesów oraz przekazania informacji, które pomogą temu zapobiegać (zobacz: https://journals.plos.org/plosbiology/s/competing-interests).
• Autorzy powinni przedstawić pełną i uczciwą listę piśmiennictwa, wymieniając wszystkich innych badaczy i innych autorów, których praca umożliwiła złożenie tekstu.
• Zgłaszający Autorzy zgadzają się, że plagiat to nie tylko przestępstwo, ale także najbardziej poniżający akt w środowisku akademickim, w związku z czym zwracają szczególną uwagę, aby żadna część ich pracy nie pozostawiła wątpliwości co do akademickiej uczciwości.

 

II. CZŁONKOWIE REDAKCJI

• Redakcja decyduje, które artykuły zostaną opublikowane, dba o jakość publikowanych materiałów. Redakcja ponosi odpowiedzialność za treści umieszczone w czasopiśmie.
• Redakcja czasopisma zobowiązana jest do zachowania poufności informacji związanych z procesem redakcyjnym. Do chwili dopuszczenia artykułu do publikacji redaktor nie może ujawniać informacji o nadesłanym manuskrypcie osobom trzecim poza:

- autorem,

- recenzentami,

- członkami zespołu redakcyjnego

- wydawcą

- korektorami, proofreaders etc. zaangażowani w wydanie czasopisma.

• Redaktorzy są zawsze gotowi do publikowania poprawek, wyjaśnień, wycofań i przeprosin w razie potrzeby.
• Redaktor nie zważa na rasę, płeć, orientację seksualną, wyznanie, pochodzenie etniczne, obywatelstwo czy filozofię polityczną autorów przy wyborze tekstu do publikacji.
• Jedynymi kryteriami wyboru tekstu są:

- znaczenie zgłoszenia dla zakresu czasopisma

- oryginalność zgłoszenia

- jakość/poziom języka zgłoszenia

- jasność argumentacji

- przestrzeganie wszystkich wymogów prawnych dotyczących zniesławienia, naruszenia praw autorskich i plagiatu.

Członkowie redakcji zobowiązani są dbać o rzetelność naukową publikowanych prac. W przypadku podejrzeń o nieuczciwe praktyki redakcja jest zobowiązana do wycofania tekstu z publikacji i podjęcia kroków wyjaśniająco-naprawczych. Wykrycie nadużyć etycznych (plagiat, sfałszowanie wyników badań, manipulacja wynikami badań, metodą, zmyślanie wyników badań itp.) powinno być zgłoszone w formie pisemnej redaktorowi naczelnemu czasopisma (e-mail: Ten adres pocztowy jest chroniony przed spamowaniem. Aby go zobaczyć, konieczne jest włączenie w przeglądarce obsługi JavaScript.). Zgłoszenia może dokonać każda osoba, która ma podejrzenie co do rzetelności tekstu. Redakcja czasopisma postępuje zgodnie z zasadami sformułowanymi przez Committee on Publication Ethics (COPE) https://publicationethics.org. W przypadku naruszenia zasad etycznych w tekście już opublikowanym redakcja wycofa artykuł ze strony internetowej, zamieszczając informację o powodach wycofania. Redakcja poinformuje o sprawie autora, instytucję, w której jest afiliowany, recenzentów, osoby poszkodowane, a także, jeśli będzie to konieczne, inne organy nadzoru etycznego.

III. RECENZENCI

• Recenzenci biorą udział w procesie redakcyjnym na etapie recenzji i mają wpływ na decyzje podejmowane przez redaktorów odnośnie do publikacji tekstu.
• Recenzentów obowiązuje ustalony termin wykonania recenzji. Recenzent niezwłocznie dostarczy swoją recenzję lub powiadomi Redaktora o wszelkich okolicznościach, które uniemożliwiają mu terminowe dostarczenie recenzji.
• Wgląd w recenzowane prace mają tylko osoby do tego upoważnione, tj. redakcja, autor i recenzenci.
• Recenzja powinna dotyczyć tylko kwestii merytoryczno-formalnych tekstu. Recenzent powinien być bezstronny w swojej ocenie pracy. Recenzent powinien wyrażać swoje poglądy w sposób jasny i jednoznaczny.
• W przypadku występowania konfliktu interesów z autorem/autorami tekstu powinni zostać wyłączeni z procedury recenzowania. Sędzia równorzędny odrzuci współpracę przy recenzji po wykryciu jakiegokolwiek konfliktu interesów i poinformuje Redakcję o takich przypadkach.
• Recenzent jest zobowiązany do zidentyfikowania niedostatecznej identyfikacji źródeł lub potencjalnego plagiatu, o których przypadkach powinien powiadomić Redakcję.

IV. Open Acess

PPGIOŚ zapewnia natychmiastowy otwarty dostęp do treści, zgodnie z zasadą, że swobodne udostępnianie badań naukowych sprzyja większej globalnej wymianie wiedzy.

V. Oświadczenie o ochronie prywatności

Nazwy i adresy e-mail wprowadzone na stronie czasopisma będą wykorzystywane wyłącznie do określonych celów tego czasopisma i nie będą udostępniane w żadnym innym celu ani żadnym innym podmiotom.

Code of Ethics

To ensure the high quality and research integrity of our publications, Legal Issues in Mining and Environmental Protection implemented the standards of ethical behavior promulgated by the Committee on Publication Ethics (COPE) in Code of Conduct and Best Practice Guidelines for Journal Editors and Ethical Guidelines for Peer Reviewers. All parties involved in the publication process: Author, journal editor, reviewer, publisher are obliged to follow COPE standards in publication ethics.

All manuscripts submitted to a peer-reviewed publication are expected to conform to COPE's standards of ethical behavior.

I. Authors

• The Author is obliged to conduct and reliably present scientific research and to interpret it objectively.
• The text should disclose sources of data and information that will allow the research to be replicated.
• The text should represent the intellectual property of the Author. Plagiarism, autoplagiarism are inadmissible.
• In order to prevent cases of academic dishonesty, such as "ghost-writing" and "guest authorship," all persons who have contributed to the publication should be mentioned as co-authors. All authors must approve the final version of the work and agree to its publication. In their written statement, the authors indicate their contribution to the creation of the work submitted.
• The publications that influenced the Author's work should be appropriately quoted.
• If the Author notices significant errors in their publication, they should immediately notify the Editor-in-Chief. An erratum, annex, or correction should be published in cooperation with the Editor-in-Chief and the Publisher, or the publication should be withdrawn.
• All authors are obliged to provide retractions or corrections of mistakes in case of detection.
• Results of research may not be published in more than one journal.
• Conflicts of interest are relationships that entail professional subordination and economic dependence and social relations, which can affect the impartial assessment of the merits of the text. The editors require the Author to make a statement on the lack of conflict of interest and provide information that will help to prevent such conflict. • Authors shall provide a full and honest list of references, crediting all other researchers and other authors whose work has made the submission possible.
• Submitting Authors agree that plagiarism is not only a crime but also the most degrading act in the space of academia and therefore shall take special care that no part of their work should leave any doubt in terms of academic honesty.

II. Editorial Board

• The editorial board decides which papers will be published, takes care to ensure the quality of published material. The editorial board accepts responsibility for all the content featured in the journal.
• The editorial board of the journal is under the obligation to keep confidential any information related to the editorial process. Until the moment of the admission of the article for publication, the Editor and any editorial staff shall not disclose any information about the submitted manuscript to any third party other than:

- corresponding Author

- peer referees

- members of the editorial team

- the publisher

- copyeditors, proofreaders, typesetters involved in the production of the journal as appropriate.

• Editors are always ready to publish corrections, clarifications, withdrawals, and apologies as needed
• The Editor shall not consider the authors' race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy as pertinent to selecting the text for publication.
• The sole criteria for the selection of the text shall include:

    - the submission's relevance to the field of study and the scope of the journal

    - the submission's originality

    - the quality of the submission's language

    - the clarity of the argument

    - observance of all legal requirements regarding libel, copyright infringement, and plagiarism.

Members of the editorial board are obliged to take care to ensure the scientific integrity of the published works. If dishonest practices are suspected, the editors are obliged to withdraw the text from publication and to take steps to explain and remedy the situation. The detected cases of the transgression of ethics (plagiarism, etc.) should be reported in writing to the journal's Editor-in-Chief (e-mail: Ten adres pocztowy jest chroniony przed spamowaniem. Aby go zobaczyć, konieczne jest włączenie w przeglądarce obsługi JavaScript.). The report may be submitted by any person who holds suspicions as to the integrity of the text. The editorial board acts in compliance with the principles formulated by the Committee on Publication Ethics (COPE) https://publicationethics.org. If transgression of the ethical tenets concerns a text, the editors will remove the paper from the website, providing information on the reasons for withdrawal and, in the case of a text published in print, the editors will publish an appropriate statement in the next edition of the journal. The editorial board will notify of the matter, the Author, the institution he/she is affiliated with, reviewers, the aggrieved persons, and also, if necessary, other ethical oversight bodies.

III. Reviewers

• Reviewers participate in the editorial process at the review stage and influence the decisions made by editors with regard to the publication of the text.
• Reviewers are required to meet a set review deadline. The peer referee shall promptly deliver his or her review or notify the Editor about any circumstances that prevent him or her from the timely delivery of the review.
• Only authorized persons, i.e., the editors, authors and reviewers, have access to the reviewed works.
• The review should concern only substantive and formal aspects of the text. The peer referee shall be impartial in their evaluation of the submission. The peer referee shall express his or her views clearly and unambiguously.
• The peer referee shall decline the reference upon the discovery of any conflict of interest and shall inform the Editor about such instances. If there is a conflict of interest between reviewer(s) and Author (s) of the text, such reviewers should be excluded from the review procedure.
• The referee is obliged to identify insufficient identification of sources or potential plagiarism, of which cases the referee shall notify the Editor.

IV. Open Access Policy

Legal Issues in Mining and Environmental Protection provides immediate open access to its content on the principle that making research freely available to the public supports a greater global exchange of knowledge.

V. Privacy Statement

The names and e-mail addresses entered in this journal site will be used exclusively for the stated purposes of this journal. They will not be made available for any other purpose or to any other party.
